Terms of Service

These Terms of Service (“Terms”) govern your use of the Cala mobile application (“App”) provided by Spark Digital Inc. (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use Cala. If you are between 13 and 17, you must have the consent of a parent or legal guardian.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.
3. Description of the Service
Cala is a screen time management app that uses Apple’s Screen Time APIs (FamilyControls, ManagedSettings, and DeviceActivity frameworks) to block access to apps and websites according to schedules you configure.
3.1 Screen Time and Blocking Functionality
- Blocking may not be perfect. We work to minimize issues but cannot guarantee error-free blocking.
- You are responsible for your own usage. Cala is a tool, not a guarantee of behavior change.
- Apple controls the underlying APIs. Changes to iOS may affect functionality without prior notice.
- Authorization can be revoked at any time through your device’s Settings app.
3.2 Emergency Access and Safety
You are solely responsible for ensuring you can access critical apps and services when needed. The App provides an emergency unlock feature and the ability to revoke Screen Time authorization at any time. We are not liable for any harm resulting from your inability to access a blocked app.
3.3 Not Medical or Therapeutic Advice
Cala is a general wellness and productivity tool. It is not a medical device, therapeutic service, or substitute for professional advice.
3.4 On-Device Data
Your schedules, blocked app selections, habits, and usage data are stored locally on your device. We do not have access to this data. Apple’s Screen Time API uses opaque tokens, meaning neither Cala nor any third party can determine which specific apps you have selected.
4. Subscriptions and Payments
Cala Pro is available as an auto-renewable subscription. Payment is charged to your Apple ID account. Your subscription automatically renews unless turned off at least 24 hours before the end of the current period. Manage or cancel subscriptions in Apple ID Account Settings. Refund requests must be directed to Apple.
5. User Conduct
You agree not to use the App in any way that violates applicable laws, interfere with its operation, restrict another person’s device without consent, or circumvent security measures.
6. Intellectual Property
The App and all its content, features, design, and code are owned by us and protected by intellectual property laws.
7. Privacy
Our collection and use of information is described in our Privacy Policy, incorporated into these Terms by reference.
8. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR ACHIEVE ANY PARTICULAR RESULT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the App or violation of these Terms.
11. Termination
We may suspend or terminate access at any time. You may terminate by deleting the App and canceling any subscription.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada. Disputes shall be resolved in the courts of Surrey, British Columbia.
13. General Provisions
These Terms constitute the entire agreement. If any provision is unenforceable, the remainder stays in effect. Apple and its subsidiaries are third-party beneficiaries.
